Acceptable Use & Fair Use Policy

This Acceptable Use & Fair Use Policy explains how you may use the Podwise website, mobile applications, CLI, OpenAPI, Skills, and related services (collectively, the "Services"). It is intended to protect the availability, security, and integrity of the Services for everyone.

Acceptable Use

You may use the Services only for lawful purposes and in accordance with the rights of others. When you import a private feed, upload audio, or otherwise provide content to Podwise, you are responsible for ensuring that you have the rights and permissions needed for Podwise to process that content on your behalf.

You may use Podwise through its supported web, mobile, CLI, OpenAPI, and Skills interfaces for legitimate personal or business workflows.

Prohibited Use

You must not:

• Use the Services in violation of applicable laws or the rights of others, including intellectual property, privacy, and publicity rights
• Upload, import, or process content that you do not have the right to use
• Probe, scan, or test the vulnerability of the Services, or attempt to bypass authentication, security controls, usage restrictions, or rate limits
• Interfere with or disrupt the Services, including by generating traffic intended to exhaust resources, degrade performance, or prevent others from using Podwise
• Use multiple accounts, shared credentials, or other methods to avoid plan limits or technical restrictions
• Sell, resell, sublicense, or provide unauthorized access to the Services, an account, or API credentials
• Use the Services to distribute malware, facilitate fraud, harass others, or create deceptive or unlawful content
• Scrape, copy, or extract Podwise data or generated content at scale except through an interface and for a purpose expressly supported by Podwise

Fair Use for Enterprise Public-Episode Processing

Enterprise accounts include unlimited AI processing for eligible public podcast episodes, subject to fair use limits. Private feeds, private imports, and uploaded audio use the usage-based billing terms in the applicable Enterprise agreement.

"Unlimited" public-episode processing applies to eligible public episodes. It does not permit unbounded request volume, excessive concurrent processing, or automated activity that harms the availability or performance of the Services.

To protect Podwise and its users, we may apply reasonable per-hour, per-day, concurrency, or other technical limits; delay or reject unusually high-volume requests; or temporarily restrict processing when activity appears abusive or creates a material risk to the Services. Supported automation through the Podwise CLI, OpenAPI, and Skills is permitted when used within these fair use expectations.

Enforcement

Depending on the nature and severity of a violation, Podwise may warn you, rate-limit or reject requests, temporarily restrict a feature, suspend access, or terminate an account in cases of serious or repeated abuse. Where reasonably practicable, we will explain the restriction and provide a way to request a review.

Changes to This Policy

We may update this Policy as the Services, security risks, and usage patterns evolve. Material changes will be communicated through the Services or another reasonable channel.
